Charging of Rs 103 Cr excess fee from medicos:  Himachal  to file reply against MMU Medical College

Himachal Pradesh Government would file detail reply on the writ petition filled by Maharishi Markandeshwar University & Medical College Kumarhati, Solan district of Himachal Pradesh against  the June 9, 2022  order of HP Private Educational Institutions Regulatory  Commission which has directed University to refund Rs 103.96 Cr. excess fee charged from the students. The Petition was heard by Division bench of Acting Chief Justice Sabina and Justice Satyan Vaidya fixed the next hearing on the matter on April 11, 2023. The counsel for the state stated that Government would file detail reply in the matter and sought time for the further hearing which was allowed by the court. It is worthwhile to mention that on July 23, 2022 Court also stayed the impugned order of  Himachal Private Educational Institutions Regulatory Commission had passed order against Maharishi Markandeshwar University & Medical College Kumarhati, Solan district. It is worthwhile to that Commission acting on the Complaint filled by some of students directed the university to refund Rs 103.96 Cr. excess fee charged from about 1100 MBBS students between 2012 and 2020. On June 9 taking cognizance of two separate Complaints, HPPEIRC found the respondent University and others guilty for charging excess amount of Rs. 6.05.500/- from Dr. Nividita and Rs. 8,95,500 / – from Dr. Yamini which amounts to Rs. 15,01,000. Commission said in the order that records of University submit before it also revealed that more than 1100 students who passed out and studying between 2012 to 2020 were charged excess fee tunes to Rs.1,03,965,300. Commission invoking section 11 of H.P. Private Educational Institutions ( Regulatory Commission) Act, 2010 and rule 6 (b) of the Commission, also slapped and imposed  penalty of Rs 45.00 lakhs penalty on the petioner University for charging excess fee from the complaints. The Regulatory body exercising its legitimate power on the violators ordered the respondents to deposit the penalty amounts within three months in the bank account of HPPERC from issuance of this orders .
