Urban Development Department disqualified Nagar Panchayat Arki member Surrender Sharma for encroachment and construction three-story building on 150 sq meter state government lands.
In an order passed by the Director of Urban Development, Mr. Gopal Chand said that under section 16(1)(c) of the Himachal Pradesh Municipal Act, 1994, Surender Sharma was disqualified as a member of Nagar Panchayat, Arki, with immediate effect and he ceased to perform as an office bearer of the civic body.
Director, Urban Development also stated that a complaint was filed on dated 14.12.2022 by Anuj Gupta against disqualified Member( Ward No.4, N.P. Arki) regarding encroachment upon the Govt. Land in Khasra no. 255 measuring 03-60 Sq. mt. , Khasra No. 256 measuring 67-86 Sq. mtr. and Khasra No. 260 , Rakwa 52-03 Sq. mt. situated in Mauza Arki in Solan district.
Deputy Commissioner Solan ordered with concerned Sub Divisional Officer (C) to probe the charges by sending a fact-finding report on the matter.
Sub Divisional Officer (C), Arki submitted the report to DC Dolan that on the probe by Tehsildar, Arki found that revenue record said land recorded in the ownership of Govt. of H.P. and in possession of HPPWD as per revenue records.
The Member was also provided an opportunity to respond to the complaint but he could not defends the status of revenue records and being Encrochers on the government lands he was disqualified under HP MC Act under the relevant sections.
