Oberoi eviction proceedings in Wildflower Hall: High Court stays  excutive order of the Himachal Govt

Himachal Pradesh High Court stayed the executive order of the Himachal Pradesh Government in eviction proceedings against the Oberoi group at Wildflowers Hall near Charabar Court and asked both parties to maintain the status quo in the matter.

The single-judge bench of Justice Satyen Vaidya of Himachal High Court issued a stay on the executive order of the government to take possession of Oberoi Group’s five-star Wild Flower Hall.

It is worthwhile to mention that the state government had taken possession of Wild Flower Hall of Chharabra this morning itself.

Now court fixed a hearing on the matter for next Tuesday directing both the parties to maintain the status quo.

Advocate General Anoop Ratna informed that the government has taken this action on previous orders of the High Court, the court to take possession of the property but the court today has put a stay on the executive order.

He said that the state proceeded with the eviction order of the property from Oberoi Group in Chharabra and now waiting for the ensuing orders of the court in the matter.

Earlier this morning, HPTDC and the district administration along with heavy police force reached Chharabra in about 30 vehicles and captured the hotel of Oberoi Group.

This created a stir among the employees of the Oberoi Group. The government took over the property worth crores of rupees built on 22 acres of land with 86 rooms. This was confirmed by the Director of Tourism Mansi Sahay.

It is noteworthy that in October 2022  the High Court has justified the decision of the government to take back this property of Oberoi Group.

The HC has justified the government’s decision to cancel the agreement with the company.  The court has upheld the state government’s authority to take back the property from the Oberoi Group.
