Himral demands the amendment of the CEC

District Shimla Congress Committee Rural President Harikrishna Himral has demanded the amendment of the Chief Election Commissioner and other Election Commissioners (Appointment , Service Conditions and Tenure) Act , 2023 in the country.

And by granting Election Commissioners immunity from civil or criminal proceedings for any act done in the exercise of their official duties, whether during or after their tenure , it has done a grave injustice to the country by giving these officers a free hand. He said that this law removed the Chief Justice of India from the selection committee and replaced him with a Cabinet Minister , thereby overturning the 2023 Supreme Court directive.

Now they can be removed from their posts only through the process of impeachment in Parliament , like the removal of Supreme Court judges.

Section 16 has been challenged in the Supreme Court by NGOs such as Lok Prahari , arguing that it gives unlimited powers.

Speaking to reporters here today, Harikrishna Himral said the law shields officials from accountability , while supporters believe it protects the independent functioning of the Election Commission.

Himral said that Chief Election Commissioner Gyanesh Kumar is acting as an absolute dictator. By ignoring the recommendations of two Election Commissioners in the name of SIR, more than 130 million voters across the country have been deprived of their constitutional rights. He said that Congress is running a nationwide campaign, “Save Democracy, Save the Country,” against this grave crime of the Chief Election Commissioner.

Demanding the dismissal of the Chief Election Commissioner and the prosecution of him for treason, Himral said that the India Alliance, under the leadership of Rahul Gandhi, stands with the nation against the dictatorship and crime of the Central Election Commission. Congress will not back down from this murder of democracy and theft of public opinion. Home Minister Amit Shah is also fully responsible for this theft of public opinion and has no right to remain in this position. Amit Shah should also resign from his post.
