High Court Orders Removal of Encroachments to Improve Access to AIMSS Chamiyana

In the suburb of Chamiyana, the Atal Institute of Medical Super Specialty (AIMSS) is facing accessibility issues due to the lack of a proper road. The Himachal High Court had previously halted the operation of the super specialty departments’ OPD because of this problem. It has now been revealed that encroachments on government land are the cause of these conditions. The High Court has ordered that those responsible for the encroachments must remove them by October 13. This directive aims to ensure that the encroachments on the Chamiyana-Bhattakufar (Kamla Nagar) link road are cleared within the given timeframe, with no interference from any court.

Strict Stance on Illegal Constructions

A bench comprising Justice Tarlok Singh Chauhan and Justice Sushil Kukreja has instructed the Public Works Department to submit a status report. Following this report, the court will issue appropriate orders against those who fail to remove illegal constructions on government land. The bench emphasized that no state court or authority should interfere in matters related to these illegal constructions. Individuals who feel aggrieved by this action can directly approach the High Court to present their case.

Super Specialty Hospital Underutilized

The High Court’s intervention has also highlighted that the lack of proper road connectivity to Shimla city has prevented the operation of various departments’ OPDs at AIMSS. Until the road to the hospital is properly metalled and made suitable for vehicles, all OPDs will continue to operate at IGMC Hospital Shimla.

100 Crore Hospital Without a Road

During the hearing, the Advocate General informed the court that the Chamiyana Super Specialty Hospital was built at a cost of over 100 crore rupees, with advanced medical equipment installed. Despite this, the hospital remains underutilized due to the absence of a proper access road.

High Court’s Directive

The High Court stressed the importance of proper connectivity for public health objectives. It is essential to have a road that allows at least two small vehicles to pass each other easily. Encroachments causing narrow and inconvenient roads cannot be tolerated. Those responsible for the encroachments must remove them by October 13, or the High Court will take necessary action.
