HC quashes Shimla MC delimitation
In major setback to BJP government, Himachal High Court today quashed the delimitation and reservation roster done by the government ahead of Shimla Municipal Corporation (MC) elections. Himachal Pradesh High court prounced a reserved order on the Petition filled by a Congress Councilor Simi Nanda( Nabha Ward ) who had challenged the delimitation and reservation roster in the High Court. The court after hearing both the parties accepted the Petition after finding allegations made in the applicant true. Petitioner had challenged the delimitation process alleging that process was conducted in tearing hurry against the state High court earlier order which maintained that delimitation should be held more than six months earlier to any Election process.The appellant alleged that the correct process of delimitation had not been followed. The appeal went on for a long time in court and on May 13, the court had reserved the decision after the hearing. In the delimitation process Jairam goverment increased number of wards by seven increasing them from 34 to 41. High court prounced its order in the open court cancelling the delimitation and the reservation roster done by the administration. So now all this process would have to be done again. It is worthwhile to mention here that now if government wants to constitute new wards, then the entire process of delimitation of wards would have to be done again. The five-year term of the existing councilors of Shimla MC is going to expire on June 18, 2022. With the court’s order coming today, the chances of the election hanging for a long time have increased.
