DGP-Businessman Row: Complaint shows dissatisfaction with the police investigation 

The Complaint showed the dissatisfaction with Himachal Pradesh Police Probe regarding the businessman DGP row in Himachal Pradesh High Court on Wednesday.

A hearing was held in the Division Bench of Justice MS Ramachandran Rao and Justice Jyotsna Rewal Dua on Wednesday on the complaint of businessman Nishant Sharma.

The counsel for the state of Himachal Pradesh said that the status report of the case submitted that Kangra Police has registered an FIR in the matter as per the direction of the high court. 

Amicus curries and counsel for the complaint  Neeraj Gupta expressed his dissatisfaction in the court with regards to the police investigation so far and said that the culprits should have been interrogated in this case. Despite registering an FIR in this case, those who were threatened have not been identified.

During the hearing counsel for the complaint said that the police probe could not be trusted in the matter and court should order constitute SIT to investigate the case.

The complaint said that he was not satisfied with the security cover extended to him following the court’s direction. 

The court orally said in this matter that this matter should be investigated by a senior officer. On this, the counsel for the state said that the matter would be investigated by an ASP rank officer. The state also assured to strengthen the security cover to the complaint. 

The complaint also stated in the court that he didn’t supply a copy of the proceedings of the investigation report after the FIR by the Kangra police. The High Court instructed the state to supply a copy of proceedings of the investigation after registration of FIR to the complaint and counsel for the complaint as well.

The Chief Justice stated in the court that during the previous hearing, the court did not order to file an FIR against the DGP however the court order was misquoted attributing the Media report without going through the facts.

CJ indicated that the media should restrain from conducting a media trial in this case it should present the facts as per the order of the court. Now the next hearing of this case will be on December 4.

It is noteworthy that after the High Court took cognizance of this case, on November 17, an FIR was lodged in McLeodganj, Dharamshala on the complaint of the businessman.

 Police have taken footage of eight CCTV cameras in Bhagsunag. Through these, the police are claiming to have reached the accused.

Noida businessman Nishant, who hails from Himachal, was threatened by some people by blocking his path in Bhagsunag on October 27. 

He complained about this to Kangra Police on 28 October. Police did not register an FIR on Nishant’s complaint for 21 days.

After the court took cognizance, an FIR was registered in this matter. In the complaint given to SP Kangra, Nishant has stated that there is a threat to his and his family’s life.

In fact, on August 25, there was a fatal attack on Nishant Sharma’s family in the courtyard of their house in Noida. Nishant and his two-and-a-half-year-old son were injured in this. Its CCTV footage is also available. Haryana Police is investigating this matter.

Nishant had said in the press conference that the Noida attack accused has links with retired bureaucrats from Himachal. Therefore, after Noida, on October 27, he was also threatened by blocking his way at Bhagsunag in Dharamshala.
