Abhishek Manu Singhvi challenges the February 27 RS election results in Himachal High Court 

Renowned Lawyers and Congress candidate from Himachal Pradesh Abhishek Manu Singhvi today moved before the  Himachal Pradesh High Court challenging the February 27, 2024, Rajyasabha election results declaring BJP candidate Harsh Mahajan winner based on a lottery draw.

Mr Singhvi himself moved an election petition before the Himachal Pradesh High Court challenging the validity of the rules of the lottery draw after the tieing of votes in the Rajyasabha election.

Interacting with media persons Mr Singhvi said that he had challenged the procedure of the lottery draw before the Himachal Pradesh High Court as there are no such rules in the Rajyasabha election process.

He said that the notion of a lottery draw does not exist in the election rules and he has challenged the February 27 election results in which he had lost the RS election despite the outcome of election results being tied to 34 each. 

He said that nothing exists in the rule book about the RS lottery draw and toss therefore the outcome of the Feb 27 election was not valid.

Talking to us advocate General of Himachal Pradesh informed us that the matter was also vetted by the law department and the process of declaration of election results was not found on the rule of election.

In a high voltage drama on February 27, six MLAs of the Congress party crossed vote in favor of BJP candidate Harsh Mahajan, and including the support of three Independent members, Harsh Mahajan was declared the winner in the elections despite Congress having a strength of 40 members in 68 members assembly and BJP 25 only. 

Congress party has a letter disqualifying all six MLAs from the party for defying the Whip of the party in the Vidhansabha.
