A rape accused sentenced for 20 yrs RI
A man was sentenced to 20 years prison and fined Rs 25,000 by the Special Court in Shimla for raping a minor on Thursday .
The accused, Subhash, (who appeared to be her maternal grandfather) booked under sections 376, 506 of the IPC and section 6 of the POCSO Act.
Spl court after hearing the prosecution and defense the court held the accused guilty under sec.376, 506 of IPC and sec 6 of POCSO act sentencing him to undergo 20 yrs regrious imprisonment, Rs 25000 fine and Rs 2.50 lakh compensation.
The brief facts of case
On December 3, 2021, When the victim was going to school, the accused Subhash raped her in the forest and threatened to kill her if she told anyone. On 12.12.2021, Subhash Chand again raped the victim twice by forcefully dragging her into his house at around 8 pm.
When the victim’s mother took her to the hospital for checkup, it was found that she was pregnant for 6 months.
On the basis of these facts, FIR was registered under sections 376, 506 of IPC and section 6 of POCSO Act at Police Station Chirgaon. During the trial, the prosecution examined 17 witnesses to prove the case and at the conclusion of the trial, arguments were heard and the Court of Special Judge, Shimla convicted the accused for the above alleged offence.
