PWD Nikita eligible to admit in MBBS:HC

The dream of becoming a doctor of meritorious disabled student Nikita Chowdhary would now be fulfilled as Himachal Pradesh High Court has ordered Dr. Rajendra Prasad Medical College Tanda to admit her in MBBS. The division bench of Justice Sabina and Justice Sushil Kukreja passed a verdict on the petition of physical disable Nikita Chaudhary today.

In three paged order passed by the court said that said after the medical board of PGI Chandigarh certified her disability 78 percent therefore she is eligible for admission in MBBS course. Petitioner has challenged the decision Medical College to disqualified her from admission stating that  due to Medical Council of India rule no students with a disability of up to 80 could not be admitted to MBBS degree course. It is worthwhile to mention here that Nikita, who is residents of Sarotri village of of Kangra district, had cleared the NEET exam for MBBS in the first attempt.  But Tanda Medical College had refused to give admission in MBBS on her disability ground. It was after High court took cognizance on the petition of affected students that PGI Chandigarh medical board was ordered to issue fresh medical disability certificate to candidate which found her suffering with 78 per cent disability.  Petitioner also had precured a disability certificate from a Private Medical College Chandigarh which also found her 78 pc disable. The petitioner knocked the door of Himachal Pradesh High cout as Dr Rajinder Prasad  Medical College Tanda, in Kangra district  assessed her disability 90 percent and rejected  her claim for MBBS admission.

Aggrieved Nikita also pleaded for justice by filing similar petition before principal of the medical college abd  top officials of the previous government.  Finally she filed a petition in the High Court through senior advocate Sanjeev Bhushan.  The High Court ordered the director of PGI to assess Nikita’s disability and submit the certificate directly to the court by December 9. On Monday, the High Court agreed to the arguments of senior advocate Sanjeev Bhushan and ordered Nikita to get admission in MBBS.
