Himachal High Court fixes hearing in the Wildflower Hall case on December 15

Himachal Pradesh High Court today fixed the hearing of Wildflower Hall taking over a case by the state government on December 15.

A single bench of Justice Satyan Vaidya has issued the notice to the state government on a review petition against taking over wildflower property and the state would file a reply in the matter on December 8.

 The counsel for the Oberoi Grou Rakeshwar Lal Sood told the media today that the court has issued a notice to the government to reply, this notice will have to be replied to by December 8.  The next hearing in the case will be on December 15. 

Additional advocate general I N Mehta said that the government would file its reply by December 8 and will hear the case on December 15.  

The petitioner said that the government was directed in Arbitration awards to lease out the property to the petitioner. On November 17 state government passed an executive order to take back the possession however On November  18 Oberoi Group challenged this and the court upheld the government’s executive order.  

Rakeshwar Lal Sood said that the government admitted in the court that it had made a mistake in taking possession.   HC  today directed the state to take action as per the previous orders of the division bench order of the Himachal Pradesh court.

He said that the government has already presented its stand regarding taking back this property and the government is not in favour of keeping the property with the group.

  In this, Original Miscellaneous Petition has court has restrainted the state government from taking over the above property from the Oberoi Group in the 17th November order.
