Bharatiya Janata Party constitutes “Save Land, Save House” committee: Bindal

With a view to saving the land and houses of Himachali citizens settled across the state for the past decades, Bharatiya Janata Party has constituted “Save Land, Save House” committee. This committee was constituted by BJP State President Dr. Rajiv Bindal whose convener will be BJP’s senior spokesperson and MLA Trilok Jamwal, Member Secretary State Vice President Bihari Lal Sharma, Member MLA Sudhir Sharma, Chief Spokesperson Rakesh Jamwal and State Vice President Balbir Verma.

Member and MLA Sudhir Sharma said that daily wage laborers and farmers across the state, who have lived on government-granted land for generations, are now on the verge of becoming homeless again due to the Congress government’s indecisive attitude. The Bharatiya Janata Party has resolved to take this fight to a decisive stage so that the landless are not forced to become landless again. Our fight is solely for the underprivileged.

Section 163 of the Himachal Pradesh Land Revenue Act, 1954, deals with the prevention and removal of encroachments on common land. According to this section, if a person intentionally encroaches on common land, the revenue officer, either on his own or on the application of another co-owner, can evict the encroacher from the land. It is important to note that the Himachal Pradesh Land Revenue Act also contained Section 163-A, which empowered the state government to regularize encroachments on government land. However, the Himachal Pradesh High Court declared this section unconstitutional on August 5, 2025. In September 2025, the Supreme Court directed the status quo on this High Court decision, providing some relief to farmers facing the threat of eviction from their land.

1.65 lakh people had applied for regularisation of possession.

In Himachal, 1.65 lakh people applied for the land regularization policy. The validity of the policy was challenged by petitioner Poonam Gupta. A 5-bigha land regularization policy was enacted in Himachal in 2002. Under this policy, the then state government sought applications from encroachers on government land. Over 1.65 lakh people applied for land regularization. The previous BJP government amended the Land Revenue Act and added Section 163-A, under which it was decided to grant and regularize land ranging from 5 to 20 bighas. In August 2002, a division bench of two High Court judges ordered the process to continue, while refusing to grant leases.
