90 yrs old dupe for Rs 50,000 No justice after 3 yrs legal battle

Last three years were trumatic period for the 90 years lady as she gone through toughest battle of looming sward of Covid pandemic, isolation and soical deprivation moreover she felt harrassed by the snail paced justice delivery system. Advocate D.D. Shame who is waging legal battle for a 90 years old elderly woman said that his 90 years old client waiting for justice for the  recovery of Rs 50000 from a man. Woman moved in the court after lodging a case (1471 / 2019) registered in Dec 3, 2019. Three years have lapsed but service couldn’t be completed as opposite party could not be served summons. Mr Sharma laments that it clearly predictable as 90yrs old lady may not be alive to see the result of this case filed for recovery her hard earned money which she paid to the man out pity and with promise to returned within 3 weeks.  Mr Sharma said that lady have registered a case against a milkman who daily deliver milk to about 20 persons in the heart of the shimla  city every day and  residing just- 3/4 Kms away florm the court premises.  As many as 15 dates were fixed for the service.  Even wareant was issued March 3 and June 3 2022 second time, unfortunately summons or warrant couldn’t served.It show how presecution and summons system works. The pendency in the litigation is hurting his clients and she didn’t  knows where she should perches as Justice delayed is justice denied, he added.
